TERMS AND CONDITIONS OF SALE

Orders

1. The customer, once the purchase has been made, will have definitively validated his order and verified the details of the order, its total amount, as well as the shipping costs, accepting the conditions of sale.

2. At the moment in which the client validates his order and the payment is checked, CimentArt Microcement SL will immediately issue an acknowledgement of receipt of the same or an invoice by electronic means. The contract will be understood therefore concluded once the payment of the client to CimentArt Microcement SL is confirmed.

Availability of the products

All orders are subject to the availability of the products. In case the customer has placed the order and it turns out that the product is not available, we will notify the customer immediately. The amount of the item charged and not shipped will be paid or replaced by another item of similar characteristics (at the customer’s choice) as soon as possible to the customer, by the same means of payment used for the purchase.

Right not to accept an order

4. CimentArt Microcement SL has the right not to accept an order in the following circumstances:

  1. For lack of availability as provided in the previous section,
  2. When the security systems indicate that the order may be fraudulent.
  3. When there are reasons that indicate that the customer is a minor.

Product prices

5. The price of the articles is duly indicated in the general price lists of CimentArt Microcement SL or in any of our offers sent and they will always be specified in the invoice. These prices will be those in force at the moment of the order.

6. The prices exposed in our price lists do not include the shipping costs, which will be communicated to the client in the invoice or budget and these shipping costs will always be reflected in the invoice.

The price of the transport is calculated according to the articles purchased (value of the article, type of article and quantities) and according to the transport company chosen for the shipment and the geographical area where the shipment has to be made.

7. All prices are shown in Euros (€) and do not include the corresponding VAT.

Deliveries

8. The delivery of the articles will be made during normal working hours at the address indicated by the customer when placing the order, after confirmation of payment.

9. In the event that you are not available to receive a delivery, (and depending on the carrier), the order will be returned to the carrier’s warehouse or office, so that you can collect your order in person. Alternatively, it is possible that the carrier may reattempt to deliver your order. We will make every effort to ensure that your order is delivered in the shortest possible time. However, we will not be liable for any loss or delay to your order for reasons beyond our control.

10. Under no circumstances are the transport companies obliged to take the products up to elevated floors and/or arrange the goods in places intended for their storage. Deliveries will always be made at street level.

11. In the event that, at the time of delivery, the packaging is damaged, the customer will be asked to open the package in the presence of the carrier to check the condition of the goods. In the event of any damage to the items, the customer must detail it on the delivery note that the company keeps once signed, either physically or digitally. Also take photos of the damaged items. Then you should contact CimentArt Microcement SL either by phone at +34 682 472 886 or by email to logistica@grupocimentart.com and report what happened.

In this sense, CimentArt Microcement SL will replace without any cost the articles damaged or lost during the transport, as long as the following conditions are fulfilled:

  1. That the delivery has been made by a carrier chosen by CimentArt Microcement SL.
  2. That the client notifies by the means described above to CimentArt Microcement SL of these damages or losses within 72 hours after the delivery date.
  3. That they provide the photographs that evidence the claim and confirm that they detailed in the delivery note of the transport company.

General conditions of environmental management

12. Our packaging is 100% recyclable. The purchaser is responsible for the recycling of our packaging in the places designated for this purpose. Contribute to a green planet.

Returns and refunds

13. The customer has 14 days to return products. This period begins on the day of receipt of the product.

14. Products must be returned in their original undamaged packaging, accompanied by the invoice within the period stated above.

15. If the return is of a product with a custom-made colour because the customer requested it, different from our standard colour charts on our website www.grupocimentart.com no returns will be accepted.

16. The batch and expiry date is written on all our packaging. We do not accept returns of material with an expiry date 2 months before its expiry date.

17. In case of return, the shipping costs are always at the expense of the buyer.

18. To return products, please proceed as follows:

  1. Send us a return request by mail to logistica@grupocimentart.com, enclosing photographs of the packaging to be returned, the invoice issued and the reason for the return.
  2. Once your request has been received and approved, send us the goods. The delivery address is: CimentArt Microcement C/ San Ramón 153. CP: 03560 – El Campello (Alicante – Spain). The refund of the value of your article will be refunded once the inspection of the article has been carried out.
  3. Once received and verified that your item is in good condition, in its original packaging and unopened, we will process the refund. Please note that the cost of return postage will be at the customer’s expense.

19. The customer will receive an invoice or credit note specifying the refund of the product and this will be made within 15 days of receipt of the returned products at our facilities, once the goods have been checked, provided that they are in perfect condition, both in their packaging and in unopened and unused condition.

20. CimentArt Microcement SL is a distributor company of microcement and its derivatives, it is not a company of microcement application, therefore it can not be responsible in any case of total or partial refunds requested by both the end customer and the application company, for these application works, outside our company.
